The Federal High Court in Abuja has awarded N3 million in damages to a customer, Chukwunweike Akosa Araka, after determining that Jumia Foods (operated by Ecart Internet Services Nigeria Limited) unlawfully shared his phone number with Domino’s Pizza (Eat ‘N’ Go Limited) without his consent.
The judgment, delivered by Justice Emeka Nwite on February 18, 2025, emphasized the violation of Nigeria’s Data Protection Act, 2023, and relevant sections of the country’s constitution.
The court ruled that the unauthorized disclosure of the customer’s private information was an infringement of his data privacy rights.
Araka had filed the suit after receiving unsolicited marketing messages from Domino’s Pizza following an order he placed via Jumia Foods.
The court found Jumia Foods liable for sharing his personal details without explicit permission.
Reacting to the verdict, Araka stated, “This is a victory for every Nigerian who has been a victim of data misuse. Companies must realize that our private information is not theirs to trade or exploit.”
The judge’s ruling reaffirmed the legal obligations of businesses under Nigeria’s data protection laws.
While no official statement has been released by Jumia Foods or Domino’s, legal experts believe this case sets a precedent for stricter enforcement of data privacy regulations in the country.
